A Review of Islamic Law on the Practice of Polyandry: Contextual and Juridical Analysis

Abstract

This study aims to understand the perspective of Islamic law on the practice of polyandry, focusing on contextual and juridical analysis. The method used is a literature review with a descriptive qualitative approach. Data were collected from relevant books and scientific articles, then analyzed through steps of data reduction, display, and conclusion drawing, as well as validation through source triangulation and cross-checking. The results of the study indicate that from the perspective of Islamic law, polyandry is strictly prohibited as it contradicts the principles of lineage (nasab) and inheritance law. This prohibition aims to maintain the purity of lineage and legal certainty for children. Additionally, the study identifies factors that lead to the occurrence of polyandry, such as marital status uncertainty and socio-economic conditions. Strong and consistent law enforcement, along with education and socialization by the government and religious institutions, are effective measures to prevent polyandry. The conclusion of this study is that the prohibition of polyandry in Islamic law is based not only on theological considerations but also on social and juridical ones, highlighting the importance of a holistic approach to address this phenomenon.
