Cyberporn on Twitter in the Perspective of Islamic Criminal Law: An Analysis of Criminal Acts and Sanctions

Abstract

The phenomenon of cyberporn on social media—particularly on the Twitter (X) platform—has emerged as an increasingly complex form of moral crime in the digital era. This study aims to examine the framework of Indonesia’s positive law and Islamic criminal law in responding to the dissemination of online pornographic content, as well as to analyze the role of maqāṣid al-sharī‘ah as a relevant legal paradigm in the age of technology. Using a qualitative-descriptive approach through a literature review of national regulations and contemporary Islamic legal scholarship, this research finds that Indonesian positive law—although it has regulated the issue through Law No. 44 of 2008 on Pornography and Law No. 19 of 2016 on Electronic Information and Transactions (ITE)—remains reactive and has yet to adequately address the moral and spiritual dimensions of digital society. In contrast, Islamic law offers an ethical perspective through the concept of maqāṣid al-sharī‘ah, emphasizing the protection of human dignity (hifz al-‘ird), intellect (hifz al-‘aql), and lineage (hifz al-nasl). The integration of these two legal systems opens the possibility for a more comprehensive regulatory model that not only enforces legal justice but also cultivates public moral consciousness. This study concludes that maqāṣid al-sharī‘ah can serve as an ethical paradigm for the development of national law grounded in values of public welfare (maslahah) to address the challenges of cyberporn in Indonesia.
